Terms of Service

1. Introduction

Taqemak (the "Service") is provided by Smart Web Solutions and operated by Mohammed Ahmed, Saudi Arabia ("Taqemak", "we", "us"). These Terms apply to the Taqemak website (taqemak.com) and the Taqemak apps for Android and iOS. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

2. The Service

Taqemak helps businesses collect customer ratings and feedback through QR codes, manage complaints, receive complaint notifications, get AI summaries and suggested replies, invite customers to leave Google Maps reviews, and manage branches, staff users, and subscriptions.

3. Accounts

• You must be at least 18 and allowed to act for the business you register.
• The company owner is responsible for the account, its branches, its staff users, and all activity under it.
• Keep your login details private and tell us at once if you think your account was misused.
• The information you give us must be true and kept up to date.

4. Plans and Prices

• Plans are priced per branch. Each branch includes 2 active staff users. A company can have up to 10 branches.
• Billing periods are monthly, 3 months, 6 months, and yearly. Longer periods have a discount, which is shown before you pay.
• Prices are shown in your local currency in the app. They may include VAT or other taxes, depending on your country and the store.
• We may change prices. Price changes for in-app subscriptions follow Google Play and App Store rules, and you will be told before a higher price applies.

5. In-App Subscriptions (Google Play and App Store)

• Payment is charged to your Google Play or Apple ID account when you confirm the purchase.
• Subscriptions renew automatically at the end of each period for the same plan and price, unless you cancel at least 24 hours before the period ends.
• You can manage or cancel the subscription in your store account: Google Play → Payments & subscriptions → Subscriptions, or iPhone Settings → your name → Subscriptions. After cancelling, the plan stays active until the end of the paid period.
• Upgrades (more branches) start at once. The store credits the unused part of your current plan.
• Downgrades (fewer branches) start at the next renewal date.
• Refunds for in-app purchases are handled by Google or Apple under their refund policies. We cannot refund store payments ourselves.
• Deleting the app or your Taqemak account does not cancel a store subscription.

6. Website Payments (Bank Transfer)

Plans can also be paid on the website by bank transfer. The plan starts after we confirm the payment. Refunds for website payments follow our Refund Policy.

7. One Plan at a Time

A company has one active plan. If the current plan was paid on the website, a new plan can be bought in the app only during the last 3 days of it, and the reverse. When the new plan starts, it replaces the old one.

8. Plan Limits

If a company has more active branches or staff users than its plan allows (for example, after a downgrade or when a plan ends), the newest extra branches, their QR codes, and the newest extra staff users are disabled automatically. The owner is never disabled. The owner can choose which ones stay active on the Branches and Users pages.

9. Free Trial

New companies may get a free trial. When it ends, a paid plan is needed to keep using the Service. We may change or end the trial offer for new companies at any time.

10. Expired Plans

When a plan ends and is not renewed, access may be limited and QR feedback pages may stop accepting new feedback. Your data is kept so you can continue when you subscribe again, unless you delete your account.

11. Acceptable Use

You agree not to:

• Use the Service for anything illegal, harmful, or misleading
• Post fake reviews or feedback, or pay or reward customers for positive reviews
• Pressure, threaten, or harass customers who leave feedback
• Access accounts or data without permission, or interfere with the Service's security or operation
• Copy, resell, or reverse-engineer the Service

12. Google Reviews

Taqemak can invite customers to leave a Google Maps review. Each business must follow Google's review and content policies. Taqemak is not connected with Google, does not control Google reviews, and does not promise any rating or number of reviews.

13. Customer Feedback and Your Content

Your business owns its data, including feedback and complaints collected through Taqemak. You give us permission to store and process it only to provide the Service. You are responsible for how you use and reply to customer feedback, and for having the right to contact customers who share their details.

14. AI Features

AI summaries, analysis, language detection, and suggested replies are generated automatically and may contain mistakes. Review them before using or sending them. You are responsible for the replies you send.

15. Service Availability

We work to keep Taqemak available and reliable, but we do not promise uninterrupted access. Maintenance, updates, technical problems, or third-party outages (such as hosting, email, AI, or store services) may affect the Service.

16. Limitation of Liability

The Service is provided "as is". To the extent the law allows, we are not liable for indirect losses, lost profits, business interruption, or outcomes related to customer reviews or complaints. Our total liability is limited to the amount you paid for the Service in the 3 months before the claim.

17. Ending Your Account

You can delete your account at any time in the app (Account → Delete account), at taqemak.com/delete-account, or by email. We may suspend or close accounts that break these Terms, misuse the Service, or do not pay. Cancel any store subscription separately in Google Play or the App Store.

18. Changes to These Terms

We may update these Terms. If the changes are important, we will tell business users by email or in the app before they apply. Continuing to use the Service after that means you accept the new Terms.

19. Governing Law

These Terms are governed by the laws of the Kingdom of Saudi Arabia. Nothing in these Terms limits rights you have under the consumer laws of your country.
